On Thursday, June 12th, 2008 Dylan, Oliver and another aquaintance were together with a group of long-time friends at a friend’s home in the area of Walnut Avenue and Richmond Street West. They had gathered to watch the final of the NBA play-offs.
At the end of the basketball game, just before midnight, the three friends left the townhouse with the intention of going home. Dylan ELLIS was driving Oliver MARTIN and the acquaintance home. He was driving a dark coloured Range Rover SUV.
A short time after leaving the Walnut Street area, the male friend hosting the get together telephoned to say that the two men had accidentally taken his house keys.
As a result, they returned just minutes after midnight to a position facing west on Richmond Street West, just east of Walnut Street. The owner of the keys was called by one of the victims on his cell phone alerting him to the fact that they had returned with the keys.
While waiting in the SUV to return the keys, an unknown person approached the driver’s side window and opened fire upon the occupants. The acquaintance was seated in the back seat and ducked down in the rear seat.
Both deceased males, still wearing their seat belts, were shot and killed in their seated positions in the front seats of the Range Rover.
The acquaintance was uninjured.
Minutes later, officers from 14 Division arrived on the scene, located the two victims and attempted to render first aid. Emergency Services, Toronto Ambulance and Fire Department arrived and transported the two victims to hospital. They were both pronounced dead shortly after arrival.
Witnesses were interviewed and provided accounts of the shooting, including information that one or two persons were seen fleeing the scene either on foot or on bicycles.
The housing complexes around the scene were canvassed, security footage from the area seized, ground searches conducted and numerous witnesses interviewed.
